BlockGames is a web3 games publisher (operated under Block Group Limited), which is publishing Shatterpoint mobile game. We provide Services to facilitate gameplay with digital assets. To use the Services, you will also need to agree to Our Terms of Use.
The website operated by BlockGames will contain an account, which will offer access to the BlockGames account creation, in-game assets marketplace for trading and other services related to NFT purchases, content etc.
The content presented on Our website is intended to provide a summary of Our activities and Services. We may from time to time change and update information on Our website without prior notice. However, We are not liable to Our Users or any third party if the content or information on Our website is not up-to-date, accurate or complete.
By using Our Services, You automatically agree that We are not liable for any damages caused to your computer or any other device, your computer system, operational system or any other system of yours or third party devices suffered while using Our Website and/or Services. - If the User uses the Services unlawfully or against intended purpose.
- If We suspect that User is using Our Services unlawfully or against intended purpose.
- If the User breaches any part of the Terms of use.
- If the User breaches Our or Our licensors intellectual property.
Age restriction
Since use of Services involves financial operations, the users shall be ages 18 and older to enroll in such financial operations. Any user, younger than 18 years old shall abstain from taking part in financial aspects of the Services. The Company does not assume any responsibility for any damages suffered by the minor. If the Company receives information that user is younger than the legal age set out in these Terms of Use, the account will be terminated immediately.
Platform restrictions
User shall always use the account and Services for entertainment purposes only and shall restrain from:
- Using the Services and the account for your business or any sort of advertisement and tool for promotion.
- Spreading and posting any inappropriate, demeaning or any other kind of negative language and slurs and promoting any inappropriate and demeaning behavior.
- Using our services as a resident at, or located in, any of the countries, which are listed as restricted regions and jurisdictions.
- Using Our Services by relying on any software or automated bot, code or scripts.
Registration
To access Our Services, the User is required to visit Our Website at www.shatterpoint.game and initiate the registration or use credentials of the respected marketplace, the Services is purchased and/or downloaded from. The registration involves entering your credentials and other requested information including your login details. The Users are solely responsible for the safety of their login information, this includes abstaining from sharing it with any third parties. Furthermore, the Company is not responsible for Users negligent sharing of the login credentials. We expect all Users to report any public sharing of login information by anyone. The Company will never approach the users with request of confirming their login details, in such event when User is approached with such request, We expect you contact us immediately.
Software updates
The Company reserves the right to routine software updates with no prior consent. By accepting these Terms of use, User automatically consents to such software updates.
Paid services
Users will be allowed to participate in the marketplace trading, which will be connected to financial services. On-ramp services using credit cards or their own personal wallets, for exchanging those assets with other players using the marketplace. Services will be available to the Users upon written announcement by the Company.
Refund policy
Any purchases made shall be considered final and is not subject to any form of refund.
If the Purchase is made through any third-party platform, refund shall be directed to such platform and BlockGames does not assume any responsibility regarding such refund requests.
Sale and purchase of the non-fungible tokens (NFTs)
From time to time, you may be offered to buy or take part in pre-sale of NFTs on Our Website. Therefore, the following terms apply to all Users:
- If You place an order to pre-purchase of NFT, the order cannot be canceled due to the change of mind.
- Pre-purchased NFT’s shall be paid in full at the time of the pre-purchase
- There might be some delays to deliver the pre-purchased NFT’s, in that event you will be informed about the delay in advance.
If the NFT’s are sold not during the pre-sale, but available now, the Users are required to pay the price of the NFT in full and are non-refundable. On some occasions, there might be delays delivering the NFT’s, however We will inform you in advance.
If by any reason the payment is reversed or becomes invalid or We do not receive full price, the User is automatically obligated to return NFT’s back to us, if the Users fails to do so, we reserve the right to make the NFT invalid or take legal actions if necessary.
Intellectual property
Our website and content created by Us and Our licensors is protected by the intellectual property rights and shall not be distributed, sold, copied or used in any other way without Company’s or licensors prior written consent.
All artworks seen in our website is intellectual property of the BlockGames, therefore, if the User purchases NFT from Us, this does not automatically grant any ownership rights over any artwork or IP address.
Occasionally User might see certain pop-up ads or other ads/links in Our website. These links/ads and pop-ups does not belong to us and was not created by us. Therefore, before clicking on anything, do your research. The Company is not responsible for any damages caused to you or your device due to abovementioned accessing to pop-ups/ads and links.
Illegal activities
The company is not liable/responsible for illegal activities of the Users. Company shall take actions upon any activity which has illegal aspects, and the account shall be blocked and/or terminated by the sole discretion of the Company.
If the Company is approached by the authorities with court order or other documentation of such matter and power, the Company shall provide personal information and account information of the User without prior consent and notification.
Limited liability
THE COMPANY PUTS REASONABLE ENDEAVOURS AND CARE TO PROVIDE BEST POSSIBLE SERVICES TO OUR USERS. HOWEVER, WE CANNOT GUARANTEE FAULT FREE SERVICES AT ANY TIME OR SAFETY FROM CYBERCRIME. THEREFORE, TO THE EXTENT SET OUT BY LAWS AND REGULATIONS, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA OR FINANCIAL LOSS SUFFERED BY THE USERS, WHETHER IN AN ACTION IN CONTRACT, NEGLIGENCE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE THE SITE, OR INABILITY TO DO SO.ALSO FOR ANY DAMAGES SUFFERED BY INCLUDING, BUT NOT LIMITED TO FORCE MAJEURE, VIRSUSES, THEFT OR FAILURE TO PERFORM.
Communication
The users in Our application and on Our social media channels is required to act polite and stick to the topics related to Our Services and products, including questions and discussions regarding Our Services. We will not tolerate any foul language, bullying, discrimination, racism, or any other inappropriate statements and/or discussions. If We notice or We are informed about any type of inappropriate behavior on Our social media channels and/or Our website, the members who participated in such behavior will immediately be suspended from Our social media platform and/or Our website and services. In Our sole discretion, We may terminate the account of the participants.
Indemnification
To the extent permitted by law, user agrees to indemnify and hold the Company, its associates, directors, employees and other third parties harmless from any claim or demand including attorney’s fees, arising out of your use of Our Services.
